SMS Terms and Conditions

WeightWatchers® International, Inc. and WW.com, LLC (collectively, “WW,” “we,” “us,” or “our”) offers mobile messaging programs (each, a “Program”), which you agree to use and participate in subject to these SMS Terms and Conditions (the “Agreement”). By opting-in to or participating in any of our Programs, you accept and agree to this Agreement. This Agreement is limited to the Programs and is not intended to modify the Terms of Service, the Privacy Policy, or other terms that may govern the relationship between you and WW in other contexts.

Program-specific details, including the Program name, description, opt-in method, opt-out method, and help instructions are detailed immediately below:

User Opt-In: Each Program allows users to receive SMS/MMS mobile messages by affirmatively opting-into the Program, such as through the methods described above or through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join a Program, you agree that this Agreement applies to your participation in the Program and you acknowledge and agree that your information may be shared with third-party service providers who help administer the Program. By participating in any Program, you agree to receive messages sent using an automatic telephone dialing system (“ATDS” or “auto-dialer”) or prerecorded marketing mobile messages at the phone number associated with your opt-in. Although you consent to receive messages sent using an auto-dialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an auto-dialer.

User Opt-Out: If you do not wish to continue participating in a Program or no longer agree to this Agreement, you agree to opt out of each Program through the method(s) described above. You understand and agree that the foregoing option is the only reasonable method of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than the word STOP or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.


Duty to Notify: If any time you intend to stop using the mobile telephone number that has been used to subscribe to any Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt-Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of this Agreement. You further agree that, if you discontinue the use of your mobile telephone number without notifying WW of such change, you will be responsible for all damages and costs incurred by WW, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This section shall survive any cancellation or termination of your agreement to participate in any of our Programs.


Program Descriptions: The description of each Program is provided in the table above and, without limiting the scope of each Program, users that opt-in to a Program can expect to receive messages concerning the marketing and sale of products, services, and events. The Program also includes shopping cart reminders and offers, which can only be redeemed through WW's website or app.


Cost and Frequency: Each Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with WW. Message and data rates may apply.


MMS Disclosure: Each Program will send SMS TMs (terminating messages) if your mobile device does not support MMS messaging.


Our Disclaimer of Warranty: The Program is offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, or coverage change or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with any Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of WW’s control.


Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your device capabilities for specific text messaging instructions.


Changes to This Agreement: We may update this Agreement at any time, and we will post the updated version of this Agreement to our website. You understand and agree that you will be deemed to have accepted the updated Terms by your continued enrollment and/or participation in any Program after the updated Agreement is posted. As applicable, we will notify you of material changes to this Agreement via email or text message. We reserve the right at any time and from time-to-time to modify or discontinue, temporarily or permanently, any Program (or any part of it) with or without notice.
